These Terms of Service ("ToS") govern access to foliesapp.com and use of the games published by FoliesApp, including Animic. By using our services, you accept these terms without reservation.
1. Definitions
- "FoliesApp": the publisher of the games and site — see legal notice.
- "Service": foliesapp.com, the game Animic and any other game published by FoliesApp.
- "User" or "Player": any person accessing the Service.
- "Platform": Steam, Apple App Store, Google Play, or any other distribution platform from which the game is downloaded.
2. Acceptance and changes to the ToS
By accessing the Service, the User acknowledges having read, understood and accepted these ToS. FoliesApp reserves the right to modify them at any time; the applicable version is the one in force at the time of use. Material changes will be notified (in-game or by email).
3. Access to the Service
foliesapp.com is freely accessible. FoliesApp games may be free or paid depending on the case, and are downloaded via the Platforms (Steam, Apple App Store, Google Play). FoliesApp does not guarantee continuous availability of the Service and may suspend access for maintenance or technical reasons.
4. Player account
Using multiplayer features may require creating an account (via the Platform or directly via FoliesApp). The User agrees to provide accurate information and to protect their credentials. Any use of the account is the responsibility of its holder.
FoliesApp may suspend or delete an account for breach of these ToS, in particular for cheating, harassment, illegal content, or abusive use.
5. Microtransactions and in-app purchases
FoliesApp games may offer optional purchases: cosmetics, unlockable content, battle passes, etc. All purchases are processed exclusively by the Platforms the game is distributed on (Steam, Apple App Store, Google Play). FoliesApp does not process any payment directly.
Refunds
Any refund request must be addressed directly to the Platform that processed the purchase. FoliesApp cannot issue direct refunds, has no access to the user's payment methods, and has no access to the Platforms' transaction history.
Refund procedures by Platform:
- Steam: request via help.steampowered.com/en/refunds/ — refunds possible under conditions (typically under 14 days and under 2 hours of playtime).
- Apple App Store: request via reportaproblem.apple.com.
- Google Play: request via play.google.com/store/account/orderhistory or the Google Play help center.
Virtual content (skins, virtual currency, battle pass…) acquired in a game is subject to Platform terms and gives no right to any monetary counter-value outside it.
6. Player behavior
In multiplayer games (notably Animic), the User agrees to:
- Respect other players — no harassment, discrimination, or hate speech
- Not cheat (use of cheats, exploits, bots, unauthorized modifications)
- Not disrupt the service (DDoS, exploitation of vulnerabilities, etc.)
- Respect voice content: Animic's voice recognition mechanic assumes appropriate use of the mic — no illegal, racist, sexist, or defamatory speech
Any breach may result in a warning, temporary or permanent suspension of the account, without refund of purchases already made.
7. Intellectual property
The games, brands, creatures, designs, sounds, and all creative elements published by FoliesApp are protected by copyright and trademark law. The User is granted a personal, non-transferable license, limited to the use foreseen by the game.
Streaming and creating videos / derivative content for non-commercial purposes is allowed and encouraged, provided FoliesApp is credited as publisher.
8. Personal data
Personal data processing is described in the privacy policy.
9. Limitation of liability
The Service is provided "as is". FoliesApp strives to ensure quality and availability but cannot guarantee complete absence of bugs or interruption. FoliesApp's liability is limited to proven direct damage and does not cover indirect damage (data loss, lost profits, etc.).
FoliesApp shall not be held responsible for the actions of other users or content generated by them (voice chat, nicknames, in-game user-generated content).
10. Governing law and jurisdiction
These ToS are governed by French law. In case of dispute and after an amicable resolution attempt, the competent courts shall be those of FoliesApp's registered office, except for mandatory legal provisions to the contrary (notably in case of consumer disputes).
